Terms and Conditions
These terms and conditions apply to all contracts between you and us.
'We', 'us, 'our', and “Mireva” mean Mireva Online Bookshop of Mons. Carmel Zammit Street, Msida MSD 2023, any connected organization that actually supplies goods ordered by you and any successor to its business;
'You', 'your' means the person ordering products under these terms and conditions.
'Working days' means Monday to Friday from 8.00am to 4.00pm and excludes any public holidays which may fall between Monday and Friday.
'Product' means the items or books you have ordered from us.
Mireva Online Bookshop is operated by Mireva, Mons. Carmel Zammit Street, Msida MSD 2023, registered in Malta, VAT registration number MT10415310.
Mireva is a Registered Trade Name and Trade Mark and are registered in Malta in accordance with the Trademarks Act 2000 of the Laws of Malta. Trade marks number 17998 Mireva.
Mireva Online Bookshop
These terms and conditions govern your use of the Mireva website operated by Mireva Online Bookshop. By using the website, you acknowledge and endorse that you have read, understood, and agreed to be bound by these terms and conditions. If you do not accept and agree to these terms and conditions, you may not use the website.
Changes to these terms and conditions
Mireva may, in its discretion, change, supplement, or amend these Terms and Conditions as they relate to your future use of the website from time to time, for any reason, and without any prior notice or liability to you or any other person, by posting the modified Terms and Conditions on the website. You may not change, supplement, or amend these Terms and Conditions in any manner. Each time you use the website, you acknowledge and endorse that you have read, understood, and agreed to be bound by these Terms and Conditions as they then read.
The Mireva Customer Agreement
These Terms and Conditions supplement the Mireva Customer Agreement, which applies to registered Mireva customers. The customer agreement between us includes
a. Any contract for purchases made through the website will be with Mireva, whose registered office is situated at Mireva, Mons Carmel Zammit Street, Msida MSD 2023, with VAT registration number MT 1041 5310 and shall be governed in all respects by Maltese law and you hereby submit to the non-exclusive jurisdiction of the Maltese courts. Completion of the contract between you and us will take place as soon as you place your order on our website. This will be deemed to be our acceptance of your offer and to have been effectively communicated to you.
b. Mireva must receive payment of the whole price for the goods that you order before your purchase order can be accepted, and the contract formed. Payment is taken immediately as soon as you place your booking on our website. Once payment has been received, Mireva will confirm that your order has been received by sending an email to you at the email address you provide in your registration form, summarizing each order you have placed. The shipment email will include your name, the order number and the total price. Mireva's acceptance of your order brings into existence a legally-binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.
c. Please note that some of our processes are manual and errors can arise. We carry out frequent checks to detect any errors. If they do occur, we will act immediately to minimize inconvenience and disappointment that may be caused. We reserve the right to cancel any order where obvious errors in pricing or product description have occurred.
d. Mireva Online Bookshop shall store your personal details for its use only and will not pass such details to any third parties except to those which shall be entrusted with tasks directly relating with the completion of each transaction. Credit or/and debit card details will be only stored and handled by the payment gateway entrusted and commissioned to conduct payments and/or refunds on behalf of The Crazy Monster Clan Limited as the operator of Mireva Online Bookshop. In all respects, your data is protected in line with the Malta Data Protection Act 2001 and subsequent additions or/and amendments of the Act.
Mireva operates a complaints handling procedure which is used to try to resolve disputes when they first arise. Mireva.com aims to provide outstanding customer service. Permission to use the website
The website may be accessed and used only by individuals who are able to enter into legally-binding and enforceable contracts and must comply with all applicable laws. The website may not be used by persons in jurisdictions where access to or use of the website or any part of them may be illegal or prohibited. If you are under eighteen years of age, you may use this site if you own a personal payment card issued by an approved body (e.g. SMGB, local commercial bank, et cetera) or in conjunction with, and under the supervision of a parent or guardian. If you breach any provision of these Terms and Conditions, you may no longer use the website and Mireva may in its discretion refuse permission to access and use the site.
The website is made available to you for your lawful, personal, non-commercial use only. You may access and browse the website only using commercially available, SSL-capable Web browser software. You may print or download the pages of the Web site for your personal, non-commercial use, provided that you do not modify any of the pages or other content and you do not remove or alter any visible or non-visible identification, marks, notices, or disclaimers. The website and its content may not be copied, imitated, reproduced, republished, uploaded, posted, transmitted, modified, indexed, catalogued, or distributed in any way, in whole or in part, without the express, prior written consent of Mireva. You may not reproduce, copy, duplicate, sell, or resell any part of the website or access to the website.
Suspension of an account
Mireva Online Bookshop reserves the right to terminate this Agreement and to terminate your access to the Site immediately and without notice:
if you fail to effect on time any payment/s due to us;
if you breach the terms of this Agreement;
if, within a reasonable time, you fail to produce sufficient information to enable us to verify details furnished by you;
if it becomes evident to us that you have tried or is trying to compromise the website, or have engage or is about to engage in the fraudulent use of the website, or have been involved in illegal activity on the website.
Our aim is for Mireva to be fully accessible to customers with disabilities, providing all our customers the ability to navigate the website easily.
We have made important changes to the design so that the website can be read by screen readers. We are working towards a high level of accessibility defined by the W3C (World Wide Web Consortium) as AA compliant.
The website is provided on an 'as is' and 'as available' basis, and without any representations, warranties or conditions of any kind, whether expressed or implied, and including without limitation, implied conditions, warranties or representations of merchantability, fitness for a particular purpose, performance, durability, security, availability, or accessibility, all of which are hereby disclaimed by Mireva to the fullest extent permitted by law. You are solely responsible for:
a. obtaining, configuring and maintaining all computer hardware, software, telephone services, and other equipment and services necessary for You to access and use the website;
b. scanning for and preventing the receipt and transmission of viruses, trojan horses, worms or other destructive or disruptive components; and
c. maintaining a complete and current backup of all of the data contained on your computer system prior to accessing or using the website.
Regardless of the nature of the claim or the reasons for the loss and damages, Mireva’s liability is limited to foreseeable and direct damages only. Mireva will not, under any circumstances, be liable to you or any other person for any loss of use, loss of production, loss of income or profits (anticipated or otherwise), loss of markets, economic loss, special, indirect or consequential loss or damage or punitive damages, whether in contract, tort or under any other theory of law or equity, arising from, connected with, or relating to the use of the website by you or any other person.
The exclusion of certain warranties and the exclusion or limitation of certain liabilities is prohibited by law in some jurisdictions. Such limitations may apply to you. The warranty disclaimer and liability exclusion and limitation clauses survive indefinitely after the termination of this Agreement.
All title(s) are ordered subject to availability and prices quoted by Mireva.com are subject to change without notice due to circumstances beyond the control of Mireva. Should a price for a book you have ordered change, we will inform you and give you the option of either reconfirming your order at the correct price or cancelling your order. You will have no obligation to purchase the title(s) at the new price quoted.
Mireva reserves the right not to sell to customers for re-sale purposes.
Prices advertised online by Mireva are the only ones valid.
The information contained in this site may contain technical inaccuracies or typographical errors. Please note that some of our processes are manual and errors can arise. We carry out frequent checks to detect any errors. If they do occur, we will act immediately to minimize inconvenience and disappointment that may be caused. All liability of Mireva.com, howsoever arising, for inaccuracies or errors is expressly excluded to the fullest extent permitted by law. We reserve the right to cancel any order where obvious errors in pricing or product description have occurred.
Although using the latest encrypted security software, the security of information and payments transmitted via the Internet cannot be guaranteed. Any losses incurred or sustained by users who transmit information by means of email or other internet link shall be borne solely and exclusively by such user and in no event shall any such losses in whole or part be borne by Mireva.com.
Neither Mireva nor any of its Directors, employees or other representatives will be liable for damages arising out of, or in connection with, the use of this site in any way. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
Limitation of Liability
We will not be liable to you for any loss of profit, administrative inconvenience, disappointment, or indirect or consequential loss or damage arising out of any problem in relation to the products you ordered which was not within our reasonable contemplation as a probable result of a breach of contract on our part at the time that our contract with you was concluded, or where performance of any obligations to you is prevented, frustrated or impeded by any circumstance or cause beyond our reasonable control, including but not limited to, acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.
This is as follows:
a. If you notify a problem to Mireva, Mireva’s only obligation will be, at its option, to make good for any shortage or non-delivery; to replace or repair any goods that are damaged or defective; or to refund to you the amount paid by you for the goods in question to the original method of payment, unless such method is no longer valid, in which case Mireva gift receipts will be issued to the value of the refund due.
b. Mireva will not be liable to you for any indirect or consequential loss or damage arising out of any problem of which you notified Mireva under this condition and Mireva shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under paragraph (a) above.
c. Nothing in this condition is, however, intended to limit any rights you might have as a consumer or under applicable local law. Also it is not intended to, in any way, exclude or limit Mireva’s liability to you for any death or personal injury resulting from its negligence.
Nothing in this contract creates any right which is enforceable by any person who is not a party to the contract.
Mireva shall have no liability to you for any failure to deliver goods you have ordered, or any delay in doing so, or for any damage or defect to goods delivered, that is caused by any event or circumstance beyond its reasonable control. We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.
If any part of these conditions is unenforceable (including any provision in which Mireva excludes its liability to you) the enforceability of any other part of these conditions will not be affected.
Furthermore, no waiver by us, of any breach of these Terms and Conditions shall be considered as a waiver of any subsequent breach of the same or any other provision.
The website is not intended to be a comprehensive or detailed statement concerning the matters addressed; professional or expert advice or recommendations; or an offer or recommendation to sell or buy any book or other item, product or service.
Communications sent to Mireva by means of the website or email, are not considered delivered or effective unless, and until, they are actually received and processed by Mireva’s responsible representative.
Mireva is not obliged to monitor, screen, police or edit the use of the website, including postings of materials to the website, although Mireva reserves the right to do so in its discretion. Mireva will respond as it considers appropriate, in its discretion, if it becomes aware of any inappropriate uses of the website, including, without limitation, uses that constitute copyright infringement. You may report any claims or concerns (including copyright infringement claims) regarding the website or their content by sending an email to firstname.lastname@example.org.
Availability of goods you order
Our availability information is updated regularly and automatically in real time. However you may purchase goods which are out of stock but available at our suppliers. On completion of your order, you will receive an email confirming your purchase or order and informing you about the payment status. It is strongly advised that you check that the details of this email of confirmation are correct and that you keep a safe copy of it.
Mireva will see to the expeditious acquisition of the item purchased and deliver, upon receipt of the same from its suppliers locally or abroad. Delivery time depends on the order-fulfilment period taken by our suppliers, and Mireva cannot be held responsible for delays caused by suppliers or/and publishers, locally or/and abroad, who may, at their own discretion, cancel, remainder, withdraw, reprint, call back, postpone indefinitely, or otherwise, their publication.
Your orders will be processed within the next working day. We will make every reasonable effort to deliver the products you have ordered within the delivery time-frame stipulated. If this is not possible, your order will be dispatched as soon as goods become available to us. Our policy is to cancel orders if we have been unable to supply goods within 90 days, with the exception of products that have not yet been published or released or of which, a new edition is in preparation.
Kindly be aware that orders may be delivered in instalments, according to the availability of the different titles showing on Purchase note.
The dispatch and delivery times are approximate and based on working days. Delays can sometimes occur. You will receive an email as soon as you purchase the item, as well as when the order is dispatched.
Please be aware that although Mireva endeavours to bring to its customers the best value it can by running special offers, stocks are limited, and are subject to availability from the publishers or/and their distributors both locally or abroad. Data on Mireva Online Bookshop is updated automatically in real time to minimize disappointment.
By creating an account you confirm that you are aged 18 or over ( or/and as stipulated under sub-heading 'Permission to use the website' )
In placing an order you confirm that you are aware of any age restrictions on these products and assert that you are old enough to purchase them.
Certain products are subject to delivery restrictions. Products delivered to Maltese addresses can only be delivered by registered post to addresses which show on the Maltapost addresses database. No goods will be delivered to PO Box addresses, both locally or abroad. Should an address be a newly-created one, and does not feature on the Maltapost Addresses database, you may write about this to email@example.com
, and the newly-created address will be allowed after verifying it with Maltapost.
Should a postal address prove to be a problem, we will contact you about the matter.
All orders are made subject to these Terms and Conditions.
Prices and VAT
By default, books are priced in Euro €. All prices showing on the site include the relative sales tax (VAT) of 5%, (or at a rate modified by the VAT Department or other competent bodies in Malta) where and to the extent that VAT is required to be applied to the product under Maltese VAT law.
Although we make every effort to ensure that the prices on the website are correct, mistakes may occur. If we discover a mistake in the price of the products you have ordered prior to their dispatch, we will tell you and give you the option of either reconfirming your order, at the correct price or cancelling your order. If we are unable to contact you or we receive no reply from you we reserve the right to cancel your order.
Mireva reserves the right to change prices listed without notice and all product orders are subject to availability.
Calculating postage policy
All items are delivered using local registered post. There are no packaging and postage charges for deliveries to local addressees.
Books which are either purchased by Maltese residing in Malta or abroad, or purchased by non-Maltese residing in Malta or abroad, who request to have their purchases delivered to a postal address outside the territorial confines of the Republic of Malta (as determined by Maltapost), will have to bear postal charges including registration fees. These charges will be included in the payment executed on Checkout.
All promotions and special offers are subject to availability. Once they are present, promotional codes are made accessible.
When goods carry a discount, this discount need not be manifestly exposed, but will reflect in the selling price. Due to frequent changes to online prices and promotions you will always be charged the price as confirmed at the time of placing your order.
Payments for purchases on the Mireva Online Bookshop will be handled by The Crazy Monster Clan Limited. We accept payment by leading credit cards or/and debit cards (Visa, Mastercard, APS Premier, Maestro, Visa Electron, VPay, PayPal, Cashlink, Quikcash, SMGB and others).
Your card will only be charged once you confirm your purchase order. Your card will not be debited for items in your order that have not been dispatched.
Our system does not store any payment card details. Your order will be charged to the payment card that you include while you are placing your purchase order at the confirmation stage.
Be aware that it is a crime to use a false name or a known invalid credit card to pay for your order. Anyone who enters wilfully into using erroneous details or places fictitious orders will be prosecuted to the fullest extent of the law.
Goods are sold on a firm basis. This means that goods are not exchangeable, nor are they transferable or refundable. It is advisable that you ensure yourself that you are buying what you really need or wish. Orders will only be cancelled if Mireva Online Bookshop cannot fulfil your order within ninety calendar days from the date of your order.
Only books which are damaged in manufacture will be accepted for return. Such books will be replaced and if Mireva Online Bookshop does not have them in stock, it will re-order and re-supply as fast as it can. Any multi-media which forms part of a publication which is being returned, has to be returned along with the book, and must have its holographic seal or shrink-wrap intact.
No returned books will be accepted unless covered by a Returns Authorisation issued by Mireva Online Bookshop. Returns by post are made at your own risk and cost. We recommend that you use an insured registered mail service as Mireva Online Bookshop will not assume responsibility for lost goods. If the damaged book cannot be replaced, the amount paid will be refunded. Refunds will be credited to your payment card. Refunds will not be paid in cash.
Mireva Online Bookshop complies with the refund policies of the major Credit Card companies. You will be refunded the full cost of the book. Postage cost will not be refunded.
Orders for books which are in stock will be dispatched to a Malta address by registered mail within two working days from receipt of order and should reach you within fifteen days. (Excluding the Christmas period).
Should you request a delivery address outside of Malta, you may be subject to import duties and taxes. These are usually levied once the shipped goods reach your country. Such additional charges for customs clearance are to be paid by the receiver, and in no way shall Mireva Online Bookshop or its entrusted fiscal handler be responsible for these additional expenses. Furthermore, should the receiver refuse to pay, and forfeit the goods posted to him or her, Mireva Online Bookshop or its entrusted fiscal handler will not be responsible and thus shall not reimburse the buyer/payer, be him/her in Malta or abroad. As customs policies vary from country to country, it is advised that customers contact their local customs office for further details.
Note also that goods shipped to international addresses, may be opened and inspected by customs or security authorities. In such a circumstance, if goods reach the addressee in a damaged state, the cost of reimbursement is not covered by Mireva's insurance company, and thus Mireva Online Bookshop cannot be held responsible to make good for the loss.
Delivery of goods to you
a. Mireva Online Bookshop will post the goods ordered by you to the person and address you give at the time of checking-out.
b. All delivery times quoted are estimates only, based on availability, normal processing and delivery companies.
c. You will become the owner of the goods you have ordered when the goods are dispatched to you from our distribution centre.
Goods Lost in Transit
For deliveries please allow fifteen working days from date of dispatch. If, after fifteen days, you have not received your goods please contact us at firstname.lastname@example.org.
Ownership of the website
The website and its content (including all information in text, graphical, video and audio forms, images, icons, software, design, applications and other elements available on or through the website) are the property of Mireva, and are protected by international copyright and other laws. Your use of the website does not transfer to you any ownership or other rights in the website or its content. Hence, you may not allow, create, permit, or consent to any unauthorized framing of, or deep linking to, the site Mireva Online Bookshop, nor the creation of derivative works thereof, from any other website under your management or control.
Mireva Online Bookshop enjoys full Intellectual Property Rights of the website. These rights include, amongst others, copyright, database rights, design rights (be these registered or not), patents, trade marks (registered or unregistered), together with other similar rights. Furthermore Mireva Online Bookshop asserts full ownership of the site as well as the right to apply for the protection of this ownership and all Intellectual Property Rights pertaining to the site and the ownership.
All trade marks, brand names, product names and titles used in this site are trademarks or trade names of their respective holders. No permission is given in respect of use of any of the above, and such use may constitute an infringement of the holders' rights.
The website may include advertisements for, and links to, other websites or resources and businesses operated by other persons. These hyperlinks connect you to sites of other organizations which are not our responsibility. We have used our reasonable endeavours in preparing our own website and the information included in it is being made available in good faith. However, we have no control over any of the information you can access via other websites. Personal information privacy
a. When you register with our website, you will be required to choose a contact email address and password. You are responsible for all sessions and transactions taken under these details. You should keep your password safe and not disclose it to anyone. You should change it immediately if you feel it has been compromised.
b. If any of your details change, such as your address, you must inform Mireva Online Bookshop as soon as possible. You may update your details by signing into your account on the website, and update the ‘My Account’ section.
These Terms and Conditions and all related matters are governed solely by the Maltese law, excluding any rules of private international law or the conflict of laws which would lead to the application of any other laws.
For all disputes between Mireva Online Bookshop and you or any other person arising from, connected with, or relating to the website, and relating to these Terms and Conditions, transactions facilitated or conducted through the website, items ordered or purchased through the website, dealings between You and Mireva, or any related matters or any legal relationship associated therewith or derived there from ('Disputes'), the relevant parties will attempt to find a reasonable solution least onerous to the parties.
If any provision of these Terms and Conditions is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed to be severed from the rest of these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.
No consent or waiver by either party to, or of, any breach by the other party of these Terms and Conditions will be deemed or construed to be a consent to, or waiver of, a continuing breach or any other breach of these Terms and Conditions by that party. No consent or waiver will be effective unless in writing and signed by both parties.
Any rights not expressly granted in these Terms and Conditions are reserved to Mireva.
These Terms and Conditions are subject to change without notice.
The contract between us shall be governed by, and interpreted in accordance with Maltese law, and the Maltese courts shall have jurisdiction to resolve any disputes between us.
These Terms and Conditions are in addition to your statutory rights as a consumer, which remain unaffected.
All design, text, graphics and the selection or arrangement thereof, are the copyright of Mireva Online Bookshop. Permission is granted to electronically copy and print in hard copy, portions of this site for the sole purpose of placing an order with Mireva, or using this site as a shopping resource. Any other use of materials on this site, (including reproduction for purposes other than those noted above and modification, distribution, or republication) without the prior written permission of Mireva, is strictly prohibited.
These Terms and Conditions may be amended from time to time, to meet the exigencies of the time or bring them in line with any changes in laws relating to these Terms and Conditions. The newer version will be put on Site at the earliest opportune moment. For users registering to the Site for the first time, the present Terms and Conditions will apply immediately. For users who have been registered before the new Terms and Conditions have been released, there is a grace period of thirty calendar days, after which, the amended version will become effective. The continued usage of the site after the thirty days' lapse will constitute your acceptance of the newly-amended version of the Terms and Conditions. If the Terms and Conditions are not accepted, or the renewal of an amended version of the Terms and Conditions are not accepted, one may not use the website.
